KOMO TV reports that a 25-year-old man was killed when a vehicle lost control on an icy road in Westport, Washington. The vehicle then slid into a pickup truck. The crash happened on Highway 105.
The deceased, Aron Damaranville, was a passenger in the car that lost control. Mr. Damaranville was from Ocean Shores. The drivers of both vehicles were injured. Three other passengers were also injured. No further details of crash were released.
Under Washington law, a driver shall not drive a vehicle on a highway at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing. See RCW 46.61.400. It appears that the driver of the car that lost control was going too fast for the current conditions of the roadway. If that’s true, then the driver was likely negligent. The term negligence is defined as the failure to exercise ordinary care under the circumstances then existing. A driver who goes too fast on an icy road fails to exercise ordinary care.
